No. 2387 WHITEFISH PLANNING BOARD NOTICE OF PUBLIC HEARING The regular meeting of the Whitefish Planning Board will be held on Thursday, September 21, 2017 at 6:00 pm in the Whitefish City Council Chambers at 418 E Second Street. During the meeting, the Board will hold a public hearing on the item listed below. Upon receipt of the recommendation from the Planning Board, the Whitefish City Council will hold a subsequent public hearing on Monday, October 2, 2017. City Council meetings start at 7:10 pm at 418 E Second Street in the Whitefish City Council Chambers on the second floor. 1. A request by the City of Whitefish to rezone one parcel annexed into City limits from County R-3 (One-Family Residential) to WR-1 (One-Family Residential District). A request by the City of Whitefish to rezone one parcel to remove the expired Planned Unit Development overlay on the project formerly known as Coldwater Basin to WLR (One-Family Limited Residential District). A request by the City of Whitefish to rezone twelve parcels to remove the expired Planned Unit Development overlay on the project formerly known as Lookout Ridge to WRR-1 (Low-Density Resort Residential District) and WA (Agricultural District). The properties are unaddressed, 3301 Big Mountain Road and 3300 Whitefish Lookout Road S12 T31N R22W. WZC 17-18 (Compton-Ring) 4. A request by 95 Karrow llc to rezone three parcels from WI (Industrial and Warehousing District) to WI-T (Industrial Transitional District) and WT-3 (Neighborhood Mixed Use Transitional District) in conformance with the 2015 Highway 93 W Corridor Plan. The properties are located at 95 Karrow Avenue in S36 T31N R22W. No. 2386 NOTICE OF SCHOOL DISTRICT BOND ELECTION NOTICE IS HEREBY GIVEN by the Board of Trustees (the "Board") of School District No. 44 (Whitefish), Flathead County (the "District"), that pursuant to a resolution duly adopted at a meeting of the Board on June 13, 2017, a special election of the registered voters of the District will be held by mail ballot election on October 3, 2017 for the purpose of voting on the question of whether the Board may sell and issue general obligation school building bonds of the District in one or more series in the total principal amount of up to Twenty-Six Million Five Hundred Thousand and No/100 Dollars ($26,500,000.00), for the purpose of providing funds to pay the costs of designing, constructing, improving, equipping, and furnishing a new elementary school on existing District property located at East 7th Street and Pine Avenue in Whitefish, to include site work required for roads, parking and playgrounds; demolishing the 1960s portion of Muldown School and related renovations to the portions of Muldown School to be preserved; related improvements; and paying costs associated with the sale and issuance of the bonds. Each series of the bonds shall bear interest at a rate or rates to be determined at the time of sale and be payable semiannually during a term of not more than twenty (20) years. The election will be conducted by the District solely by mail ballot. Ballots will be mailed to all eligible registered voters in the District on September 15, 2017, and must be returned by each voter, by mail or in person to the District Clerk, Whitefish Public Schools, 600 East Second Street, Whitefish, Montana 59937, and if in person, during regular business hours (8:00 a.m. to 4:30 p.m.), weekdays (exclusive of holidays), September 18, 2017 through October 2, 2017, or as described in the following paragraph. On Election Day, October 3, 2017, the only place for deposit of voted ballots will be the District Clerk's Office, Whitefish Public Schools, 600 East Second Street, Whitefish, Montana, which will be open from 8:00 a.m. to 8:00 p.m., and all ballots must be in the District Clerk's Office by 8:00 p.m. in order to be counted. All ballots will be counted on October 3, 2017, in accordance with Montana law with the results, if known, expected to be released after 8:00 p.m. on that day. A qualified voter who will be absent from the District during the time the election is being conducted may: (a) vote in person in the office of the District Clerk as soon as the ballots are available and until noon on September 14, 2017; or (b) make a written request prior to noon on September 14, 2017, signed by the applicant and addressed to the office of the District Clerk requesting the ballot be mailed to an address other than that which appears on the registration records. All ballots to be mailed will be mailed no later than September 15, 2017. An elector may obtain a replacement ballot if his ballot is destroyed, spoiled, lost, or not received by the elector by personally appearing at the office of the District Clerk and by: (a) signing an affidavit form stating the reason for the request for replacement; and (b) if the reason given for replacement is "spoiled ballot," by returning the spoiled ballot to the office of the District Clerk. Ballots may be returned in person at the place of deposit listed above, or returned by mail. If returning by mail, please use the then-prevailing first-class-postage price or one Forever Stamp. Postmark date does not apply; ballots returned by mail must be received by the 8:00 p.m. Election Day deadline to be counted. Please note, all electors, as defined in MCA 20-20-301, are those who reside within the District and are registered to vote by the close of registration on September 5, 2017. For electors who miss the close of registration deadline, late registration is available through the office of the County Election Administrator until noon on October 2, 2017, and will resume on Election Day, October 3, 2017, from 8:00 a.m. until 8:00 p.m. DATED this 13th day of June, 2017.
