A Whitefish man is headed to Montana State Prison for raping a 15-year-old baby sitter.

Kory Hubble, 25, and his wife provided marijuana and alcohol to the teenage girl, then molested and raped her on Nov. 16, 2011.

Hubble was sentenced March 20 in Flathead District Court to five years in prison with no opportunity for parole. The prison term will be followed by 15 years of probation.

Hubble had pleaded guilty to felony sexual intercourse without consent.

His soon-to-be ex-wife, Nadine Lyons Hubble, 22, has pleaded guilty to felony sexual assault for her involvement in the crime.

Hubble pleaded guilty to the rape charge as part of a plea agreement that included the recommended sentence.

Lyons Hubble entered her plea without the benefit of an agreement, and she now faces between four and 100 years or life in the Montana State Women’s Prison as well as a fine of up to $50,000 when she is sentenced.

She had been scheduled to be sentenced March 20, but it was delayed until April 3 because a presentence investigation report has not yet been completed.

District Judge Robert Allison ordered Hubble to complete phase one of the state’s sex offender treatment program and designated him a Tier I sex offender, indicating the lowest risk of committing another sexual offense.

Hubble declined the opportunity to speak at his sentencing.

Hubble still faces a misdemeanor drunk driving charge in Whitefish Municipal Court after being arrested on Feb. 12. During a hearing in District Court eight days later, his attorney said Hubble had been out celebrating the anticipated completion of his case and got caught.
